CALIFORNIA PROPOSITION 65
(PROP 65)
Prop 65 is a unique California law requiring businesses to warn consumers against products that may contain trace amounts of over 900 chemicals, including lead. The thresholds for lead under Prop 65 are, in some cases, nearly 1,000 times stricter than the EPA’s “No Significant Risk Levels.” Naturally occurring trace elements, like lead, can sometimes be present in plants, minerals, and other natural ingredients due to their presence in soil — a result of the environment, not any form of adulteration.
While originally well-intentioned, Prop 65’s vague and sweeping nature has created a legal environment where opportunistic lawsuits have become rampant, targeting businesses of all sizes. These lawsuits often force companies to settle costly legal claims even when levels of concern are exceptionally low or negligible. This creates an enormous financial burden for small businesses and adds confusion for consumers.
